This is Judge Bartlett's order:
Accordingly, IT IS HEREBY ORDERED as follows:
- That the Defendants' Motíon for Summary Judgment filed on October 31,2011 is DENIED.
- That the Defendant, Gabrielle Summe. Kenton County Clerk, shall reconsider the Petitions presented to her in this matter to determine whether the required number of valid signatures are contained on those Petitions which would allow her to certify this issue to the Fiscal Court for placement on a ballot.
- The County Clerk shall report to this Court on or before June 1, 2012 as to the results of her reconsideration of these Petitions.
- That the Court's Order staying discovery in this matter shall continue in force.
This order, when combined with the passage of SB-62 is encouraging that We The People do have a seat at the table and the hard work of our patriots does have a chance against the tax-takers. It is important that you call 1-800-372-7181 and leave your legislators a message that you support SB-62 for passage in the House.

The vote was 23-12 largely along party lines. There were a few Democrats that voted for the bill — mostly those that serve on Sen. Thayer’s State & Local Government Committee. Sen. Gerald Neal, who serves on that committee from Louisville initially voted to support the bill but after Sen. Kathy Stein from Lexington said she did not believe in lowering the threshold for abolishing anything he reversed his vote. Now it is off to the House of Representatives.
Call the LRC, 1-800-372-7181 and tell the Northern Kentucky Caucus that you support SB-62. |

Wednesday, January 25 SB-62, the bill to lower the number of signatures to get NKAPC on the ballot was passed though the Senate State & Local Government Committee. This bill is authored by Senator Thayer and Senator Schickel after they were overwhelmed with complaints from their constituents. To the 26,000 (give or take) voters that signed the petition to get the NKAPC tax on the ballot but got snubbed by the political and legal machine in Kenton County, we do have a Senator that is listening. Senator Damon Thayer who represents a very small portion of Kenton County sponsored S.B. 62 that reduces the number of signatures required to get the NKAPC issue on the ballot.
We need you to call the legislative hotline 1-800-372-7181 and voice your support for this bill to all the legislators in Northern Kentucky. Thank you Senator Thayer. Stay tuned to this issue as it will be interesting to see what the legislators that represent the taxpayers of Kenton County do and say about this bill. The NKAPC with its $5 million dollar budget is mobilizing its forces to Axe this bill. |
